BetterLister Publishing Terms and Conditions

1. Limitation of Liability

BetterLister and its owners, operators, and affiliates are NOT responsible or liable for any content, accuracy, completeness, or legality of your listings. You are solely responsible for all listing content including but not limited to: titles, descriptions, prices, item specifics, conditions, photos, and any other information.

BetterLister provides tools only - we do not verify, validate, or guarantee the accuracy of any listing information. Any errors, omissions, or misrepresentations in your listings are your sole responsibility.

2. eBay Policies & Trademark Compliance

You must ensure compliance with ALL eBay policies including but not limited to:

  • Verified Rights Owner (VeRO) Program: Do NOT use trademarked terms, brand names, or copyrighted content without authorization.
  • Prohibited Items: Ensure your items are allowed to be sold on eBay.
  • Listing Practices: No keyword spamming, misleading titles, or false item conditions.
  • Intellectual Property: You must own or have the right to use all content in your listings.
  • Item Location: Items must be located where specified in your listings.

Violations may result in eBay account suspension, legal action, and financial penalties - for which BetterLister bears no responsibility.

3. Your Responsibilities as Seller

Before publishing, you MUST:

  • Verify all listing titles are accurate and do not infringe on trademarks
  • Confirm all prices are correct and as intended
  • Ensure item conditions accurately reflect the actual state of items
  • Verify all photos genuinely represent the items being sold
  • Check that item specifics and descriptions are truthful and complete
  • Confirm you have the items in stock and can fulfill orders
  • Ensure compliance with all applicable laws and regulations
4. Indemnification Agreement

You agree to indemnify, defend, and hold harmless BetterLister, its owners, operators, employees, and affiliates from and against:

  • Any claims arising from your listings or selling activities
  • Violations of eBay policies or terms of service
  • Intellectual property infringement claims
  • Customer disputes, returns, or complaints
  • Any legal fees, damages, or costs resulting from your use of this service
5. Consent and Agreement

By using BetterLister's publishing features, you acknowledge that you have read, understood, and agree to these terms. You confirm that you have personally verified the accuracy of all listing information and accept full responsibility and liability for your listings.

This consent is valid for 30 days from acceptance, after which you will be required to re-confirm your agreement to continue using our publishing services.

6. Account Registration

To use BetterLister, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

7. Subscription and Payment
  • Subscription fees are billed monthly in advance
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days notice
  • Failed payments may result in service suspension
8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. BetterLister is not liable for any damages resulting from service interruptions, data loss, or system failures.

9. Intellectual Property

All content, features, and functionality of BetterLister are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or reverse engineer any part of our service.

10. Privacy and Data Use

Your use of BetterLister is also governed by our Privacy Policy. By using our service, you consent to our collection and use of your information as described in the Privacy Policy.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the service will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Changes to Terms

We may update these terms from time to time. We will notify you of any material changes by posting the new terms on this page and updating the effective date.
